Why POA
It is useful in the situation where you:
- are traveling or living abroad; or
- temporarily or permanently lose capacity through illness, injury or disability; or
- wish to have someone else with experience to manage your finance.
Who should you appoint as your attorney?
It is important to carefully appoint your attorney as they are in a position of trust and responsibility.
An attorney can be your family member, close friend, solicitor or trustee organization. Your attorney is legally required to act in your best interest.
Register POA
There is no requirement to register a POA unless you want your attorney to deal with any real estate you own in NSW. NSW Land Registry Services is an authority to register POA. If you registered POA, later you wish to cancel it, you should register cancellation as well.
